WHEREAS, on February 13, 2009, Carl E. Swan, a/k/a Eddie Swan, and Khaki L. Swan executed a Deed of Trust for the use and benefit of First Security Bank, to secure an indebtedness therein referred to and conveyed to said Trustee the land therein described and hereafter described, as shown by said Deed of Trust recorded in Deed of Trust  in Book 225, at page 260, of the land records in the office of the Chancery Clerk of Tunica County, Mississippi;

WHEREAS, default has been made in the covenants contained in said Deed of Trust and the entire indebtedness secured thereby having been declared to be due and payable, in accordance with the terms of said Deed of Trust, and the holder of said indebtedness having requested the undersigned Substituted Trustee to execute the trust and sell said land in accordance with the terms of said Deed of Trust;

NOW, THEREFORE, I, Bard E. Selden, Jr., as Substituted Trustee, under written appointment dated August 17, 2009, executed by First Security Bank, which is recorded in Book 228, page 480, in the Chancery Clerk’s office of Tunica County, Mississippi, will sell on Tuesday, February 8, 2011, at public outcry, within legal hours, between the hours of 11:00 a.m. o’clock and 4:00 p.m. o’clock, at the west or front door of the Tunica County Courthouse in the Town of Tunica, Tunica County, Mississippi, to the highest bidder for cash, the following described property situated in Tunica County, Mississippi, to-wit:
A 2.2 acre tract of land located in the Northwest one quarter of the Southwest one quarter of Section 12, Township 7 South, Range 12 West, Tunica County, Mississippi, and more particularly described as:

Beginning a point in the center of Crouch Road that is the Northwest corner of the Southwest one quarter of said section; run thence East along the centerline of said section a distance of 667 feet to a point marked by an iron rod; run thence East along said line a distance of 100 feet, more or less, to the centerline of a bayou; run thence South 67?44’18” West a distance of 429.41 feet to a point by a power pole; run thence South 87?19’ West a distance of 370 feet to a point on the West line of said Section West of power pole; run thence North along said section a distance of 180 feet to the point of beginning.

Less and except an easement for Crouch Road along West line and less and except a 30 foot easement along the South line for a road.

Meaning to describe the house and lot previously used and occupied by J. D. Crouch and Robbie V. Crouch, conveyed by them to Van Watson by Warranty Deed with Lien of record in Book Q4, page 181.

I will sell only such title to said property as is vested in me as such Substituted Trustee.
