WHEREAS, on May 27, 2005, Eldredge Thaddies executed a Deed of Trust to Lem Adams III, Trustee for the benefit of H&R Block Mortgage Corporation, a Massachusetts corporation, as recorded in the office of the Chancery Clerk of Tunica County, Mississippi, in Book 197 at Page 1; and,

WHEREAS, H&R Block Mortgage Corporation, a Massachusetts corp., assigned said Deed of Trust to Option One Mortgage Corporation by instrument dated October 25, 2005, as recorded in Book 200 at Page 593 in the office of the aforesaid Chancery Clerk; and,

WHEREAS, Option One Mortgage Corporation assigned said Deed of Trust to Wells Fargo Bank, N.A. as Trustee for Option One Mortgage Loan Trust 2005-3 Asset-Backed Certificates, Series 2005-3, by instrument dated August 9, 2006, as recorded in Book 207 at Page 223 in the office of the aforesaid Chancery Clerk; and,

WHEREAS, on January 22, 2018, the Chancery Court of Tunica County, Mississippi, in Civil Action No. 2017-62, executed and entered a Final Judgment Authorizing Judicial Foreclosure Subject to Confirmation, which Judgment was recorded in the office of the aforesaid Chancery Clerk in Book 139 at Page 131; and,

WHEREAS, the Judgment ordered that J. Mark Franklin, III be appointed as the Court’s Commissioner for the purpose of conducting a foreclosure sale of the property subject to the Land Deed of Trust; and,

WHEREAS, the Judgment ordered that the Commissioner, J. Mark Franklin, III, be authorized to execute the trust and sell the land and property described in accordance with the terms of the Deed of Trust and applicable law for the purpose of raising the sums due thereunder, together with attorney’s fees, Commissioner’s fees and expenses of sale; and,

WHEREAS, the Judgment ordered that on the request of Wells Fargo Bank, National Association, as Trustee for Option One Mortgage Loan Trust 2005-3, Asset Backed Certificates, Series 2005-3, following sale, a date for a confirmation hearing on the sale will be set; and,

WHEREAS, default having been made in the terms and conditions of said Deed of Trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, and the legal holder of said indebtedness having requested the undersigned Commissioner to execute the Trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the sums due thereunder, together with attorney’s fees, Commissioner’s fees and expenses of sale;

NOW, THEREFORE, I, the undersigned J. Mark Franklin, III being the Commissioner, do hereby give notice that on April 3, 2018, between 11:00 o’clock a.m. and 4:00 o’clock p.m., being the legal hours of sale, I will proceed to sell at public outcry, to the highest bidder for cash, at the West Front Door of the Tunica County Courthouse in Tunica, State of Mississippi, the following real property described and conveyed in said Deed of Trust, lying and being situated in Tunica County, Mississippi, and being more particularly described as follows, to-wit:

Lot No. 21 of the Cypress Village Subdivision, as shown by plat recorded in Plat Book 3, Page 51, of the records of the Chancery Clerk’s office of Tunica County, Mississippi and being located in the Northeast Quarter of Section 27, Township 4 South, Range 11 West, Tunica County, Mississippi.

REQUEST FOR PROPOSALS FOR ENGINEERING SERVICES

The Tunica County Board of Supervisors, Mississippi requests proposals from qualified firms or individuals to provide engineering services for work related to the application and implementation of approved FY 2018 CDBG project. You are invited to submit a proposal, in accordance with this request, to the Office of the Tunica County Administrator, 1058 South Court Street, Post Office Box 639, Tunica, Mississippi 38676 no later than 4:00 p.m. on Friday, April 13, 2018.

The Engineer will be responsible for performing all engineering services through project closeout in accordance with federal, state and local laws, regulations and policies. The scope of work includes but is not limited to the following: 1) prepare plans and specifications, 2) distribute bid documents, 3) assist in bid opening and prepare bid tabulation, 4) assist in the execution of construction contracts, 5) hold pre-construction conference, and 6) perform construction inspection including periodic reports to the Tunica County and approve all payment requests.

Tunica County is an Equal Opportunity Employer.  Tunica County encourages Minority-owned Business Enterprises (MBEs) and Woman-owned Business Enterprises (WBEs) to submit proposals.  Tunica County also encourages Section 3 eligible businesses to submit proposals. Section 3 of the Housing and Urban Development Act of 1968, as amended (12 U.S.C. 17010) requires, to the greatest extent feasible, that Tunica County and its contractors that participate in the above referenced Program give opportunities for job training and employment to lower incomes residents of the town. Section 3 also requires that contracts for work in connection with the Section 3 area be awarded to Section 3 eligible business concerns.

One (1) original and six (6) copies must be submitted in a sealed envelope and marked with the following language: “Proposal for CDBG Engineering Services.” Proposals will be evaluated on the following factors: Qualifications (40 points), Experience (40 points) and Capacity for Performance (20 points). To be evaluated properly, the following must be addressed in detail:

Qualifications – List of qualifications of persons to be assigned to project;

Experience – Information regarding the firm’s experience and the projects previously undertaken, including the type and amount of grants awarded, the projects activities, and the status of the projects;

Capacity for Performance – Identify the number and title of staff assigned to provide services.

Tunica County will designate a selection committee to evaluate each proposal. The selection committee may hold proposals for a period of not to exceed thirty (30) days for the purpose of reviewing the content of the proposals and investigating the qualifications of the firms and assigned individuals. The County reserves the right to reject and and/or all proposals.

Subject to CDBG award(s) and the removal of all environmental conditions, Tunica County will award a contract with the qualified individual or firm whose proposal has the highest number of cumulative points issued by the selection committee and determined to be the most advantageous to Tunica County, price and other factors considered. The contract will include scope and extent of work and other essential requirements. An individual contract will be executed for each awarded project, and the contract will be on a fixed price basis.  Tunica County has the authority to terminate the selection at any time.
